Protecting a Local Developer
An insured Mexican developer purchased a parcel of land in one of Mexico's booming resort destinations with the intention of building a condominium complex. Construction and pre-sales were proceeding smoothly until the insured received a letter. The letter claimed the parcel of land on top of which the condominium complex was being built belonged to the beneficiary of a Mexican bank trust. The claimant argued he was the rightful owner of the land because the trust was created prior to the developer's purchase of the same land.
